The short answer
What Illinois families should know.
A party can request that witnesses be excluded so they cannot hear other witnesses testify. Illinois Rule of Evidence 615 directs the court to order exclusion when requested, subject to its exceptions. The purpose is to preserve independent testimony, not to remove a spouse from their own case.
A party is different from an ordinary witness
Rule 615 does not authorize excluding a party who is a natural person. It also identifies exceptions for certain representatives, people shown to be essential to presenting the case, and people authorized by law to attend. Whether someone qualifies for an exception should be raised with the judge. A supportive friend who may testify does not automatically gain an exception by sitting beside a party.
Ask for clear instructions about the order
Counsel should clarify who must leave, where witnesses should wait, and whether the instruction also addresses remote access or discussions about testimony. The practical details matter when hearings use video links or witnesses share transportation. A witness should not assume that watching a livestream or receiving a summary from another person is consistent with the court’s direction.
Prepare witnesses independently
Each witness should focus on personal knowledge and accurate recollection. Coordinating stories can damage credibility and may defeat the purpose of exclusion. Before court, explain the logistics and tell witnesses whom to contact when they are needed. If an expert’s presence is necessary to understand other testimony, counsel can explain that need to the judge rather than allowing the expert to remain without addressing the issue.
Report accidental exposure promptly
Mistakes can happen: a witness may enter too early or overhear testimony. Tell counsel what occurred instead of trying to conceal it. The court decides how to address the situation in context. Accurate disclosure allows counsel to assess whether testimony was affected and seek appropriate directions. The witness should avoid discussing the incident with other waiting witnesses until counsel has clarified the next step.
Prepare

- Arrange a waiting location and contact method.
- Review the specific exclusion instructions before testimony begins.
Avoid
Common missteps
- Passing summaries of testimony to waiting witnesses.
- Assuming a remote hearing makes witness-exclusion rules irrelevant.
