The short answer
What Illinois families should know.
An appeal and a stay serve different purposes. Filing a notice of appeal does not by itself suspend every obligation in a divorce order. A party seeking to pause enforcement must examine the kind of order and satisfy the applicable stay procedure.
Money judgments have security requirements
Rule 305(a) addresses enforcement of money judgments. A stay under that provision requires a timely appeal and approved security presented and filed within the prescribed time or an authorized extension. Security can take several forms, and the rule addresses the amount needed to protect the judgment, costs, and anticipated interest. The judge considers specified circumstances when full security is not reasonably available. A party should not simply stop paying because a lawyer has filed appellate papers.
Nonmoney orders involve a separate decision
Rule 305(b) permits a court, on notice and motion with an opportunity to be heard, to stay certain nonmoney judgments and appealable orders on just terms. The rule contains exceptions and special treatment that must be checked for the specific family-law relief involved. An order affecting children cannot be analyzed as though it were only a disputed cash award. Identify exactly which obligation should pause, for how long, and what protections would preserve the other party's interests.
Build the stay request alongside the appeal
Give counsel the entered order, enforcement dates, financial records relevant to security, and a clear explanation of the harm alleged. The motion should distinguish harm from ordinary disagreement with the ruling and offer workable conditions. If the trial court denies relief, appellate procedures may provide a further route, but timing and the supporting record matter. Meanwhile, determine which obligations remain in force and comply with them. A later reversal does not make an earlier decision to ignore an enforceable order automatically proper. Stay planning is therefore part of the immediate postjudgment discussion, not a task to postpone until enforcement begins. A proposed stay should identify the specific obligation affected and the duration requested. Keep security arrangements and any conditions clear enough for the parties to know what remains enforceable.
