The short answer
What Illinois families should know.
Financial records can be central to an Illinois divorce, but receiving them in discovery does not automatically make them admissible. Identify the source, the purpose of the exhibit, and the foundation needed for each record rather than treating every financial document as the same kind of evidence.
Start with a complete and identifiable record
Preserve full statements, account identifiers subject to privacy rules, date ranges, and the production source. A cropped balance screenshot may omit ownership, transaction details, or the period it covers. Tax returns also need careful identification: a draft, signed return, amended return, and transcript may contain different information. Know which version is being offered and who can explain it. Do not assume that a number on a return proves the character or availability of every dollar.
Business-record requirements matter
Rule of Evidence 803(6) provides a hearsay exception for qualifying records of regularly conducted activity. It addresses when the record was made, the knowledge behind it, regular business practices, and trustworthiness. A custodian or other qualified witness can supply the foundation, or a certification may satisfy Rule 902(11). That rule requires advance written notice and access to the record and certification sufficient to permit a fair challenge. A document obtained from a business is not automatically a qualifying business record for every asserted fact.
Consider the actual evidentiary purpose
A party's statement in a financial document may raise a different analysis under Rule 801(d)(2) when offered against that party. Authentication, hearsay, completeness, and relevance remain separate questions. A tax return may contain information supplied by several people, so an accountant's involvement does not necessarily prove every underlying assertion. Discuss stipulations or admissions that can narrow genuine disputes and avoid unnecessary witness expense. For contested items, connect the exhibit to the specific income, asset, debt, or transaction issue the judge must decide. A working spreadsheet should retain links to the underlying records rather than replace them. Identify whether a return is original or amended and include relevant schedules. A summary page may omit information necessary to understand business income, deductions, ownership, or a discrepancy between years.
Prepare
Useful next steps
- Identify the exact document version, period, and source.
- Arrange necessary witnesses or certifications well before the hearing.
- Tie each exhibit to a disputed financial fact.
Avoid
Common missteps
- Assuming production in discovery equals admission at trial.
- Treating every tax-return entry as independently verified by the preparer.
