Illinois Maintenance Explained Without the Legal Fog

How Illinois courts decide whether maintenance is appropriate and address amount, duration, review, modification, and termination.

The short answer

What Illinois families should know.

Maintenance is not automatic, and it is not a punishment or reward. Illinois courts first decide whether maintenance is appropriate under statutory factors. If it is, the court determines amount and duration under the applicable guidelines or explains a non-guideline result.

Eligibility comes before the formula

The court considers income, property, needs, present and future earning capacity, impairment from domestic duties, time needed for education or employment, standard of living, marriage duration, age, health, tax consequences, agreements, and other just factors.

Guidelines do not answer every case

When statutory guidelines apply, they provide a framework for amount and duration. High combined income, unusual compensation, substantial property, disability, or other circumstances may require a factor-based analysis outside or beyond a simple calculator.

Labels in the judgment have consequences

Maintenance may be fixed-term, reviewable, indefinite, modifiable, or made non-modifiable by agreement. Review is not the same as automatic extension, and termination terms should be understood before judgment.

Modification and termination require the actual judgment

Changed circumstances, retirement, remarriage, death, or qualifying cohabitation may affect maintenance, but the result depends on statutory law and the agreement or order. Do not stop paying based on an assumption.

Prepare

Useful next steps

  • Prepare accurate income histories, budgets, tax returns, and employment records.
  • Document education, caregiving history, health limitations, and realistic earning capacity.
  • Model the interaction of maintenance, property, insurance, housing, and taxes.

Avoid

Common missteps

  • Treating an online calculator as a final answer
  • Ignoring tax, insurance, and liquidity effects
  • Using vague review or termination language

Frequently asked questions

Clear answers to the first questions.

Can someone receive maintenance after a short marriage?

Marriage duration matters, but it is one factor. A short marriage does not create an absolute bar, just as a long marriage does not guarantee an award.

Does adultery affect maintenance in Illinois?

Maintenance is decided without regard to marital misconduct. Conduct can matter only when independently relevant to another authorized issue, such as dissipation.

Does remarriage end maintenance?

The recipient's remarriage generally affects maintenance under Section 510, but the judgment and effective date should be reviewed. Other relationships require a different statutory analysis.
