The short answer
What Illinois families should know.
A lawyer's prior or current relationship can raise a conflict that affects representation in a divorce. The important questions are whom the lawyer represented, what information was received, how the matters relate, and whether the applicable rules allow the representation.
Identify the relationship accurately
Distinguish a consultation from an engagement and a joint representation from representation of only one spouse. Keep the engagement letter, invoices, appointment records, and correspondence. A lawyer who once represented a family business did not necessarily represent every family member individually. Conversely, a brief consultation may still create duties concerning confidential information.
Connect the prior work to this dispute
Illinois professional-conduct rules address conflicts involving current clients, former clients, and prospective clients. The analysis is specific to the relationship and information involved. A divorce touching the same business transaction, estate plan, or sensitive financial facts may raise different concerns from an unrelated matter years earlier.
Use a focused process to protect confidentiality
Tell your current lawyer privately about the concern. Do not publish the confidential information you want protected or send it to opposing counsel as proof. Counsel can evaluate whether a motion, an agreement, screening, or another response is appropriate. The court decides a disqualification request on the governing standards and supporting facts.
Keep the requested remedy in proportion
Disqualification can disrupt a case and affect a party's choice of counsel. It is not a substitute for responding to an unfavorable argument, challenging improper evidence, or reporting a separate professional-conduct concern. Timing matters as well: delaying a known objection until the eve of trial can complicate the request and its practical consequences.
Prepare
Useful next steps
- Create a dated list of the lawyer's earlier services and consultations.
- Preserve engagement documents without circulating privileged material.
- Identify the specific overlap between the earlier representation and the present case.
Avoid
Common missteps
- Contacting many lawyers solely to try to prevent a spouse from hiring them.
- Assuming an ethics concern automatically invalidates every prior court order.
