Presenting Sensitive Facts Without Turning a Divorce Filing Into an Attack

Sensitive facts sometimes matter in an Illinois divorce, but the pleading should explain their connection to the requested relief.

The short answer

What Illinois families should know.

Sensitive facts sometimes matter in an Illinois divorce, but the pleading should explain their connection to the requested relief. Precise facts, appropriate privacy measures, and a sound evidentiary purpose are more useful than insults or unnecessary disclosure of intimate information.

State conduct and its relevance

Describe the event, date or approximate period, participants, and effect on the issue before the court. Separate what you personally know from what you infer. Rules of Evidence 401 and 403 help explain why relevance and unfair prejudice matter when evidence is later offered. A filing is not improved merely by adding embarrassing details. Ask whether each allegation helps establish a legal element, explain an immediate need, or identify a genuinely disputed fact.

Use the proper support and privacy procedure

Rule 137 requires reasonable inquiry into the factual and legal basis of signed filings and prohibits improper purposes such as harassment. Other rules address personal identifiers and confidential information. Do not assume that labeling an exhibit sensitive automatically seals it. Discuss redaction, protective relief, and any required confidential submission with counsel before filing. Keep the complete underlying record so a redacted public copy does not become the only available version.

Keep the requested remedy specific

A court can evaluate a request more effectively when the pleading states what should change and why. For example, identify a concrete exchange condition or document-production need rather than asking the judge to punish someone for being difficult. Preserve relevant evidence privately and avoid repeating allegations on social media. Statements in a filed motion still need proper proof when disputed at a hearing. If the information is uncertain, disclose the uncertainty to counsel instead of turning it into an absolute accusation. A restrained factual presentation can address serious conduct without minimizing its significance. Consider who will be able to read the filing later, including evaluators or other authorized participants. If a medical or school record is necessary, identify the relevant portion and the appropriate confidentiality procedure before attaching an entire history.

Prepare

Useful next steps

  • Prepare a dated factual account with supporting records.
  • Flag private identifiers and sensitive exhibits before filing.
  • Connect each allegation to the particular relief requested.

Avoid

Common missteps

  • Including intimate details solely to embarrass the other party.
  • Treating an allegation in a pleading as already proven.
