Evidence and discovery

The Discovery Conference Required by Rule 201(k)

Illinois Supreme Court Rule 201(k) is designed to make discovery disputes specific and, when possible, resolve them without a motion.

The short answer

What Illinois families should know.

Illinois Supreme Court Rule 201(k) is designed to make discovery disputes specific and, when possible, resolve them without a motion. It requires the stated consultation effort and a statement accompanying a discovery motion. A useful conference addresses the missing information, the objections, and a practical proposed solution.

Prepare a focused agenda

Identify the request numbers and the exact response problems. Separate missing documents from incomplete answers, formatting issues, privilege claims, and disagreements about scope. Send the relevant requests and responses so the discussion can be substantive. An organized agenda makes it possible to agree on some items even when the parties continue to disagree about others.

Consult meaningfully

Rule 201(k) states that parties shall facilitate discovery and make reasonable attempts to resolve differences. It assigns the consultation responsibility to counsel responsible for trial and addresses unavailability or unreasonable attempts by opposing counsel. Follow the actual rule, not an assumption that sending any demand letter is enough. Keep a clear record of who participated, when the consultation occurred, and what was discussed.

Use narrowing proposals

A date limitation, defined account list, search explanation, or agreed production format can sometimes resolve a dispute. Rule 201 also provides for protective orders and proportionality. Consider whether the same necessary information can be obtained with less expense or intrusion. A compromise about how to produce records is different from surrendering a claim or agreeing that the records prove the other party’s position.

Document agreements and remaining issues

Confirm specific commitments, production dates, and unresolved objections in writing. If a motion remains necessary, the record should distinguish issues already resolved from those requiring a judicial decision. The required Rule 201(k) statement should accurately describe the consultation effort. A motion that ignores a promised response date or exaggerates what occurred can distract from an otherwise legitimate request for missing information.

Prepare

Useful next steps

  • Prepare a request-by-request deficiency chart before the conference.
  • Offer practical alternatives that preserve access to necessary information.
  • Record the agreed deadlines and accurately describe unresolved issues.

Avoid

Common missteps

  • Assuming an unanswered email always satisfies the consultation requirement
  • Misstating the other lawyer’s position in the motion
  • Continuing to litigate an item after the parties have resolved it

Frequently asked questions

Clear answers to the first questions.

What should a discovery conference record show?

Identify the disputed requests, each party’s position, proposed compromises, unresolved items, and the date and method of discussion. Preserve the correspondence so a later motion accurately describes the effort to resolve the dispute.
