The short answer
What Illinois families should know.
A rollover IRA needs both a clear divorce agreement and a transfer method that preserves its tax treatment. Moving retirement money to an ordinary checking account and then paying a former spouse can create consequences that a properly documented transfer between IRA custodians would avoid. Start by identifying the account and obtaining its custodian’s divorce-transfer requirements.
The word rollover does not explain ownership
A rollover IRA may contain funds from an earlier employer plan, later contributions, investment growth, and money combined from several accounts. Its current title does not show when every dollar was earned. Collect statements from before the marriage, the original employer plan, each rollover, and the current account. A missing historical statement can matter more than the most recent balance when counsel evaluates what portion is subject to division.
Distinguish an IRA from an employer plan
A qualified domestic relations order is commonly used for certain employer retirement plans. An IRA follows different transfer procedures. The IRS describes a transfer of an IRA interest under a divorce decree or qualifying written instrument as a transfer that is not itself taxable. The recipient then owns the transferred IRA interest. Ask the custodian what documents and account setup are required before agreeing to a deadline or assuming an employer-plan form will work.
Write the economic terms precisely
An award should identify the account, valuation date, percentage or fixed amount, treatment of gains and losses, and allocation of transfer fees. Decide how contributions and withdrawals between valuation and transfer will be handled. With a percentage division, market movement may affect both parties; a fixed dollar award can allocate that risk differently. The agreement should also address cooperation if the custodian rejects incomplete paperwork.
Check the result before closing the file
Obtain written confirmation that the transfer occurred and review the recipient account’s tax character. Traditional and Roth balances should not be treated as interchangeable simply because their statement values match. Preserve the judgment, transfer instructions, and confirmations for tax reporting and future basis questions. A later withdrawal by the receiving spouse is a separate transaction with its own tax rules, even when the divorce transfer itself was tax-free.
