When Family Mediation May Be Inappropriate or Need Safeguards

Mediation can help resolve parenting disputes, but safe and meaningful participation matters.

The short answer

What Illinois families should know.

Mediation can help resolve parenting disputes, but safe and meaningful participation matters. Illinois Supreme Court Rule 905 recognizes that an impediment can justify excusing a case from referral. Concerns should be raised through the proper process rather than simply ignoring a mediation order.

Identify the actual barrier

The rule's comments identify circumstances including family violence, substance abuse, and mental or cognitive impairment that may interfere with mediation. Explain the practical effect: fear of retaliation, inability to speak freely, difficulty understanding proposals, or inability to participate reliably. A history of arguments alone does not describe the issue adequately. Provide the mediator and counsel with relevant protective orders and specific concerns through appropriate confidential channels.

Do not confuse disagreement with inability to negotiate

Parties can disagree strongly and still exchange proposals. The more important questions are whether each person can evaluate choices, decline an unacceptable term, obtain advice, and participate without coercion. Missing financial information can also make a financial negotiation premature. Identify which information is needed and whether a limited discussion of another issue would be useful while that information is obtained.

Consider accommodations carefully

Remote participation, separate sessions, interpretation, or disability accommodations may address some barriers. Rule 905 expressly addresses remote mediation and meaningful language and communication access. An accommodation should solve the actual problem; a video session does not necessarily remove intimidation occurring outside the session. Discuss who can be present, how private communications will occur, and how the process can be paused if participation becomes unsafe or ineffective.

Use the court process when an exception is needed

The court determines whether an impediment warrants excusing referral under Rule 905, with local rules governing implementation. Counsel should identify the applicable procedure and present the relevant facts. A mediator facilitates discussion and does not replace independent legal advice about a proposed agreement. Before signing, make sure the terms are understood and that unresolved questions have not been hidden by pressure to finish the session.

Prepare

Useful next steps

  • Bring the referral order and identify specific participation or safety concerns.
  • Request interpretation or communication accommodations before the session.

Avoid

Common missteps

  • Ignoring a court-ordered session without addressing the order.
  • Assuming mediation requires accepting a proposal or meeting face to face.
