Responding to Document Requests in an Illinois Divorce

How Rule 214 document requests work, from identifying records to objections, organized production, and later updates.

The short answer

What Illinois families should know.

A document request tells a party which existing records or other materials must be produced for discovery. Illinois Supreme Court Rule 214 covers paper documents, electronically stored information, and other specified items relevant to the case. A proper response requires a reasonable search, organized production or specific objections, and attention to material obtained later.

Read the categories and time periods carefully

A request for bank statements may cover several accounts and years. A request for business records may include returns, ledgers, contracts, and electronic files. Create a checklist by request number before collecting documents. If the scope is unclear or disproportionate, discuss a tailored objection or clarification with counsel. Do not silently choose a narrower period and present that collection as a complete response.

Produce usable and organized material

Rule 214 permits production as records are kept in the usual course of business or organized and labeled to match the requests. Electronic material should be produced in the specified form or an appropriate reasonably usable form. Sending hundreds of unlabeled images can make a production difficult to assess. Complete statements and clear filenames help distinguish an actual missing month from a sorting problem.

Objections do not excuse unrelated omissions

A valid objection to one request or part of a request does not automatically excuse compliance with everything else. Privilege should be raised expressly with the information required by the discovery rules. Counsel can seek a protective order when necessary. The rule also addresses an affidavit of completeness, so the person signing should understand the search and know what has actually been supplied.

Update the response when new records arrive

Discovery is not necessarily complete after a single upload. Rule 214 requires timely supplementation when responsive material later comes into a party's possession or control or becomes known. Establish a process for forwarding new account statements, compensation records, or other responsive documents to counsel. Keeping a dated production list helps avoid duplicating work and allows both sides to identify what remains disputed.

Prepare

Useful next steps

  • Organize records by request number and date range.
  • Identify accounts or records held by third parties.
  • Review the proposed completeness affidavit before signing.

Avoid

Common missteps

  • Dumping unlabeled files without explaining how they answer the requests.
  • Withholding an entire category because part may be privileged.
